Cal State University and University of California Face Investigation for Unfair Student Fees
Schubert Jonckheer & Kolbe has launched an investigation into both the University of California (“UC”) and California State University (“CSU”) for failing to refund certain student fees charged for on-campus services during the Spring 2020 academic semester or quarter.
This Spring, in response to COVID-19, UC and CSU effectively closed their campuses and transitioned to online-only instruction. While this decision was a reasonable response to the health emergency, UC’s and CSU’s failure to refund the unused portion of students’ fees paid to cover the cost of certain on-campus services may constitute a breach of contract, and may have unjustly enriched the universities.
