Energizer Faces Investigation for Deceptively Marketing AA MAX Batteries
Schubert Jonckheer & Kolbe LLP today launched an investigation into the conduct of Energizer Brands, LLC for deceptively selling and marketing that its AA MAX batteries are “Up to 50% longer lasting than basic alkaline in demanding devices.”
Energizer manufactures and sells household batteries. Around July of 2020, Energizer launched an advertising campaign in which the company began prominently representing that its AA MAX batteries are “Up to 50% longer lasting than basic alkaline in demanding devices.” However, Energizer does not define the terms “basic alkaline” or “demanding devices” anywhere on the AA MAX packaging. Energizer’s packaging may mislead consumers into thinking that Energizer AA MAX batteries last up to 50% longer than other competing batteries.
