Walgreens Faces Investigation for Charging “Pink Tank” on Hair Regrowth Products
Schubert Jonckheer & Kolbe LLP today launched an investigation into the conduct of Walgreens for imposing a “pink tax” on functionally identical “women’s versions” of Hair Regrowth Treatment products.
The pink tax refers to a premium pricing tactic that imposes a higher price for gender-based products, as a result of which female consumers may end up paying more for certain goods or services. Walgreens, for example, distributes its own brand of Hair Regrowth Treatment under the “Walgreens” private label. As of February 3, 2021, Walgreens sells Minoxidil Topical Aerosol 5% (Foam), Hair Regrowth Treatment for Men at a price of $34.99 for a 3-pack supply of 2.11 ounce units, or $5.53 per ounce. Walgreens also sells this Hair Regrowth Treatment product for Women, which contains active and inactive ingredients identical to those in the men’s version, at a price of $54.99 for a 3-pack supply of 2.11 ounce units. This translates to $8.69 per ounce, reflecting a 64% premium of $3.16 per ounce.
