BSH Home Appliances Corporation (d/b/a Bosch) Faces Investigation for Potential Violations of Warranty Laws
Schubert Jonckheer & Kolbe LLP launched an investigation into BSH Home Appliances Corporation (d/b/a Bosch) concerning the company’s restrictions on replacement parts and repairs sought from unauthorized third-parties.
Bosch sells a variety of household goods, including dishwashers, refrigerators, ovens, cooking ranges, washers, and dryers. Bosch’s statement of warranty for a number of its products notes:
“If you choose to have someone other than an authorized service provider work on your Product, THIS WARRANTY WILL AUTOMATICALLY BECOME NULL AND VOID.”
Bosch’s restrictions on repairs facilitated by unauthorized service providers may violate state and federal warranty laws, including the Magnuson-Moss Warranty Act, which prohibit manufacturers from voiding an otherwise valid warranty simply because a consumer seeks replacement parts or repair services from an unauthorized service provider. Such restrictions can severely limit consumers’ access to affordable and accessible repair services for the products they own.
