Sundance Film Festival Under Fire for Failing to Refund Tickets to Cancelled Screenings
Schubert Jonckheer & Kolbe today launched an investigation into the Sundance Institute, which cancelled all-person screenings for the 2022 Sundance Film Festival but refused to refund ticket purchasers.
Just weeks before the 2022 Sundance Film Festival began, Sundance announced that it was cancelling all in-person screenings due to COVID. However, Sundance refused tor issue refunds for pre-purchased ticket packages, citing its terms of service.
According to news reports, this left many festivalgoers upset and frustrated, having spent hundreds or thousands of dollars on costly ticket packages for the in-person festival. Sundance reportedly told them that they could only use their ticket packages to watch the movies online.
For example, as reported by Independent Australia, Utah film critic Rachel Wagner “was one of many stung by Sundance’s refusal to issue refunds.” Having spent $400 expecting to attend films in person, she was “angry and felt betrayed after supporting the festival passionately since 2016.”
Instead, Sundance told ticket purchasers they could convert their packages into a charitable contribution to the Sundance Institute, which many found insulting and inadequate.
Festivalgoer Scott Hosner has travelled to Sundance every year for the past 15 years. But when Sundance refused to refund his $750 ticket package, he remarked to FOX 13, “they’ve burned me and I’ve just said I’m never coming back."
The Schubert Firm is investigating whether Sundance’s marketing of its ticket packages as providing access to in-person screenings (despite the inability to attend in-person) was false and misleading in violation of state and federal laws. Festivalgoers who purchased a ticket package to the 2022 Sundance Film Festival may be entitled to a refund.
